Is Cannabis Legal in Idaho? The 2026 Guide

No. A complete, sourced explanation of Idaho cannabis law in 2026: recreational, medical, CBD and hemp, penalties, what neighboring states allow, and the November 2026 vote on HJR 4.

Idaho is one of a shrinking number of states with no cannabis program at all: no adult-use market, no medical program, no decriminalization, and a CBD rule stricter than federal law. This guide explains what that means in practice, what the penalties are, how Idaho compares with its neighbors, and what is scheduled to happen next. It is updated whenever the law changes. It is not legal advice.

What Idaho law says

Idaho regulates marijuana under the Uniform Controlled Substances Act, Idaho Code Title 37, Chapter 27, which the state adopted in 1971. Marijuana is listed in Schedule I, the category for substances the state considers to have high abuse potential and no accepted medical use. Every part of the plant with THC, every product derived from it, and the paraphernalia used to consume it fall under the chapter.

Three points follow from that classification:

  • Possession is a crime. Three ounces or less is a misdemeanor; more than three ounces is a felony.
  • Sale, delivery and cultivation are felonies, with mandatory minimum sentences at trafficking quantities.
  • No license exists. Idaho issues no cannabis retail, cultivation, processing or testing licenses, so no business can lawfully sell marijuana anywhere in the state.

Recreational cannabis

Not legal. No adult-use bill has passed either chamber of the Idaho Legislature. No adult-use initiative has qualified for the ballot. In 2013 the Legislature passed SCR 112, a concurrent resolution declaring that Idaho would never legalize marijuana for any purpose. That is a statement of intent rather than a statute, but it describes the Legislature's position accurately more than a decade later.

Medical marijuana

Not legal. Idaho has no medical program, no physician recommendation process, no patient registry and no reciprocity with other states' medical cards. A patient with a valid Washington or Montana medical card who possesses marijuana in Idaho is treated the same as anyone else.

The one near miss was Senate Bill 1146 in 2015, which would have allowed low-THC cannabidiol oil for children with severe epilepsy. It passed both chambers and was vetoed by Governor Otter. Citizen initiatives for a medical program were attempted for the 2012, 2014, 2016, 2020, 2022 and 2024 ballots and none gathered enough valid signatures.

CBD and hemp

Idaho has permitted industrial hemp production since 2021 under a state plan run by the Idaho State Department of Agriculture. That legalized growing and transporting hemp with 0.3 percent THC or less. It did not legalize THC consumer products.

Consumer CBD products are lawful in Idaho only if they contain no THC at all and are derived from parts of the plant excluded from Idaho's definition of marijuana. Full-spectrum CBD oils that are legal federally because they test under 0.3 percent THC can be illegal in Idaho if any THC is present. The same logic makes hemp-derived delta-8 and delta-10 THC products illegal in the state.

Penalties

Idaho Code 37-2732 sets the penalties. In 2025, House Bill 7 added a mandatory minimum fine of $300 for possession of three ounces or less.

| Offense | Classification | Penalty | | --- | --- | --- | | Possession, 3 oz or less | Misdemeanor | Up to 1 year jail and/or up to $1,000; $300 minimum fine | | Possession, more than 3 oz | Felony | Up to 5 years and/or up to $10,000 | | Sale or intent to deliver | Felony | Up to 5 years and/or up to $15,000; more for larger amounts | | Trafficking (1 lb or 25 plants and up) | Felony | Mandatory minimums scaling with quantity | | Paraphernalia | Misdemeanor | Up to 1 year and/or up to $1,000 |

Driving under the influence of marijuana is a DUI. Using in public or in a vehicle is a separate misdemeanor charged alongside possession.

Idaho's neighbors

Every state bordering Idaho except Wyoming has some form of legal cannabis, and Canada legalized nationally in 2018.

  • Washington: adult-use and medical, retail since 2014.
  • Oregon: adult-use and medical, retail since 2015.
  • Montana: adult-use and medical, retail since January 2022.
  • Nevada: adult-use and medical, retail since 2017.
  • Utah: medical only.
  • Wyoming: not legal.
  • British Columbia: legal under Canada's Cannabis Act.

The border matters. Cannabis bought legally in Spokane or Missoula is illegal the moment it enters Idaho. Transporting it across a state line is also a federal offense, and crossing the Canadian border with cannabis in either direction is a serious federal crime in both countries.

Priest Lake specifically

There is no dispensary in Priest Lake, Coolin, Nordman or Priest River, and no lawful way to buy cannabis anywhere in Bonner County. Priest Lake Cannabis Company is a brand in development with no store, no license and no products. We say this plainly because people search for it, and because a straight answer is the point of this page.

What is scheduled next

On November 3, 2026, Idaho voters will decide HJR 4, a proposed constitutional amendment approved by the Legislature in 2025. If adopted, it would reserve to the Legislature the sole authority to legalize marijuana, narcotics and other psychoactive substances, closing the citizen-initiative route that other states used. It does not legalize anything, and rejecting it would not legalize anything either.

At the federal level, a 2024 proposal to move marijuana to Schedule III remains a proposal until a final rule is published. Rescheduling would ease research and tax rules for businesses in legal states but would not legalize marijuana federally or change Idaho law.

There is currently no confirmed date for cannabis legalization in Idaho. Our legalization tracker records every development as it happens.
